24Hr HomeCare recently volunteered at the TrinityKids FUNraising event held at the American Girl Place at the Grove. The event was held on November 8, 2009 to help raise funds for the TrinityKids Foundation. The event was a success!!! The TrinityKids Foundation raised approximately $45,000 this year, $15,000 more than last year. All of the families and children that attended the event had a great time and we look forward to volunteering next year.

What is the difference between private duty homecare vs. direct hire?

A. Private Duty Homecare – Homecare provided by an agency; caregivers are normally screened, bonded and insured by the agency; payments for services are made to the agency rather than paying the caregiver directly; private duty homecare is usually more expensive due to the extra insurances, caregiver screening process, criminal background checks, and payroll taxes.

B. Direct Hire – Directly employing caregivers; client becomes the employer and is responsible for payments, liability, and taxes for the caregivers; direct hire homecare is usually less expensive than private duty homecare, but puts more responsibility and risk on the client.

How do I know if my caregiver is an independent contractor vs. employee?

A. Economic Reality: If a direct hire’s salary is mainly paid by the client, they are considered an employee.

B. Level of Control: If your level of control over the caregiver is high, then the person is your employee; control means that you tell your caregiver what needs to be done and how to do it.

Example: A gardener would be considered an independent contractor since you don’t really tell him what to do.

So I have an employee, I’m not going to get caught right?

Not necessarily. According to Bob King, Household Employment Attorney and owner of Legally Nanny, people get caught all the time for direct hires because of not paying taxes for their caregivers. With the increase in in-home care over the next 5-10 years, the IRS will become more observant on household employee taxes.

What are some common ways people get caught paying someone under the table?

A. Unintentional: The most common way people get caught unintentionally is when a private hired caregiver gets laid off by the client. The caregiver then files for unemployment and the EDD sees no history of recent employment. The caregiver mentions that he or she worked as a caregiver privately for a family. EDD will then send a letter to the client saying that he or she has been identified as an employer and must pay a certain amount of back taxes.

B. Intentional: The most common way people get caught is when the caregiver and client have a “falling out” and the caregiver tells EDD about being paid under the table.

What are the consequences of hiring illegally?

As an employer, you are required by law for paying taxes on social security, medi-care, state disability, and worker’s compensation insurance. You could be liable for Federal Tax Fraud which is a felony. If convicted, you could pay up to $250,000 fines, sentenced to potential imprisonment, and have a criminal record. Realistically, you would be responsible for the taxes, penalties, and interest. If you advise a Caregiver not to tell anyone, you are committing conspiracy.

What are the advantages of hiring legally?

A. Employer:

1. Dependent Care Account: You may have access to a Dependent Care Account (DBA) issued from your employer that can qualify you to utilize $5000 in pre-taxed dollars per calendar year to pay for healthcare expenses including homecare.

2. CDCTC: You can qualify for a Child and Dependent Care Tax Credit (CDCTC) which can be up to 35% tax credit on homecare spending.

3. Peace of mind: If you are utilizing all of your tax breaks, on average you would only be paying only 4% extra when using private duty homecare rather than hiring someone privately. Is 4% worth your reputation and peace of mind?

4. Worker’s Compensation: Your Caregiver’s injuries will be covered by the worker’s compensation insurance provided by the Agency. You will not be liable for any medical costs for your injured caregiver.

B. For Employee:

1. Access to government benefits: unemployment, disability, and social security.

2. Build an employment history and establishing credit

3. Medical benefits offered by some homecare agencies

The owners of 24Hr HomeCare recently volunteered at the Walk for Multiple Sclerosis on Sunday April 19th held at the Rose Bowl. The event was held to raise awareness about Multiple Sclerosis and the continued fight to find a cure. The money you raised at the event will support education, advocacy, research and local programs that enhance the quality of life for people with MS and their families. Tyner, David, and Ryan woke up bright and early to help set up the booths, the running area, and lunch area. After setting up the walk site, the owners helped to check in walkers and direct them to the starting line.
